These Terms and Conditions govern your access to and use of our website at www.sasknationit.com and all services provided by SaskNation IT Services. By accessing or using our website or services, you agree to be bound by these Terms.

SaskNation IT Services operates in full compliance with applicable Canadian federal and provincial laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), the Canada Anti-Spam Legislation (CASL), and applicable Saskatchewan provincial regulations.

All services are subject to individual service agreements. In the event of any conflict between these Terms and a specific service agreement, the service agreement shall prevail.

Section 02

Eligibility & Account Registration

By using our services, you represent and warrant that:

You are at least 18 years of age or the age of majority in your Canadian province or territory.
You have the legal capacity and authority to enter into a binding agreement.
You will provide accurate, current, and complete information when creating an account or submitting a service inquiry.
You will maintain the security of your account credentials and notify us immediately of any unauthorized access.

Acceptable Use Policy

You agree to use our website and services only for lawful purposes. You must NOT use our services in any way that:

Violates any applicable Canadian federal, provincial, or territorial law or regulation.
Infringes upon the intellectual property rights of SaskNation IT Services or any third party.
Transmits unsolicited commercial electronic messages in contravention of CASL.
Introduces malware, viruses, trojans, or any other malicious software into our systems.
Attempts to gain unauthorized access to any of our servers, networks, or databases.

We reserve the right to terminate access to any user found in violation of this policy without prior notice.

Intellectual Property Rights

All content on this website — including text, graphics, logos, icons, images, audio clips, software, and digital downloads — is the exclusive property of SaskNation IT Services, protected under the Copyright Act, R.S.C. 1985, c. C-42 and applicable international treaties.

You are granted a limited, non-exclusive, non-transferable licence for personal or internal business use. You may not:

Reproduce, duplicate, copy, or sell any portion of our website or services without written authorization.
Modify or create derivative works based on our content.
Use our trademarks, trade names, or branding without prior written consent.

Fees, Payments & Taxes

All fees for services will be outlined in a separate proposal, invoice, or service agreement. Unless otherwise stated:

Currency

All prices are quoted in Canadian Dollars (CAD).

Taxes

GST/HST added per the Excise Tax Act (Canada).

Payment Terms

Net 30 days from invoice date unless otherwise agreed in writing.

Late Payments

Interest at 1.5%/month (18% p.a.) or max permitted under Saskatchewan law.

Privacy & Personal Information

SaskNation IT Services is committed to protecting your personal information in compliance with PIPEDA and applicable provincial privacy legislation.

Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, incorporated by reference into these Terms.

We collect only the minimum personal information necessary to deliver our services and will not sell, rent, or trade your data to third parties without explicit consent, except as required by law.

Disclaimers & Warranties

Our services are provided on an "as is" and "as available" basis. SaskNation IT Services disclaims all warranties, including:

Implied warranties of merchantability and fitness for a particular purpose.
Warranties that the website will be uninterrupted, error-free, or free of harmful components.
Warranties regarding the accuracy, reliability, or completeness of any information on the website.

Nothing in these Terms shall exclude or limit any liability that cannot lawfully be excluded under the Consumer Protection Act or other applicable Canadian consumer protection legislation.

Section 08

Limitation of Liability

To the maximum extent permitted by Canadian law, SaskNation IT Services shall not be liable for any:

Indirect, incidental, special, consequential, or punitive damages.
Loss of profits, revenue, data, goodwill, or business opportunities.
Damages arising from unauthorized access to or alteration of your data.
Any matter beyond our reasonable control, including force majeure events.

Our total aggregate liability shall not exceed the total amount paid by you in the three (3) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless SaskNation IT Services from any claims arising out of or in connection with:

Your use of our website or services in violation of these Terms.
Your violation of any applicable Canadian law or regulation.
Any content you submit, post, or transmit through our services.
Your infringement of any third-party intellectual property or other rights.
Section 10

Termination of Services

Either party may terminate a service engagement as follows:

Either party may terminate with 30 days' written notice.
SaskNation IT Services may terminate immediately upon breach, fraudulent, abusive, or illegal activity.
Upon termination, all outstanding fees become immediately due and payable.
Provisions on IP, payment, disclaimers, and liability survive termination.
Section 11

Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the Province of Saskatchewan and applicable federal laws of Canada. Disputes shall be resolved in three stages:

Step 1: Negotiation

Good-faith negotiation within 30 days of written notice.

Step 2: Mediation

Mediation through a mutually agreed mediator in Saskatchewan.

Step 3: Courts

Courts of competent jurisdiction in Saskatchewan.

Section 12

Electronic Communications & CASL Compliance

SaskNation IT Services complies with Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23. By submitting your email address, you provide express consent to receive commercial electronic messages from us.

You may withdraw consent at any time by:

Clicking the "unsubscribe" link in any email we send you.
Emailing us at admin@sasknationit.com with an unsubscribe request.

We will process your unsubscribe request within 10 business days as required by CASL.

Section 13

Third-Party Links & Services

Our website may contain links to third-party websites not owned or controlled by SaskNation IT Services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.

The inclusion of any third-party link does not constitute an endorsement or approval by SaskNation IT Services.
